When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

II. DATA PROCESSING ON THIS WEBSITE

We treat your personal data transmitted confidentially and in accordance with the legal data protection regulations and this data protection explanation. In the following, we would like to inform you in detail which of your personal data we collect, for which purposes it is processed, with whom it is shared and which rights you may be entitled to.

The legal basis for this data processing is Art. 6 para. 1 s. 1 lit. b GDPR, as we need the automatically collected data for the effective provision of our website, and Art. 6 para. 1 s. 1 lit. f GDPR, as the storage serves our legitimate interest in ensuring the stability and security of the website.
To receive reports on investments on our website you need to submit a respective request. As part of this registration process, we process the following mandatory information provided by you:
- Name of the Company
- Your Name
- Email address
We will transfer the above-mentioned data as well as the fact that you requested a copy of the report to the audit company that prepared the report as indicated on the request submission page. The prerequisite for receiving a copy of the report is that the terms and conditions of the auditing company have been accepted. Thus, the auditing company processes the above-mentioned data to be able to comprehend who accessed the report under the requirements set out in the terms. The data transfer is based on Art. 6 para. 1 s. 1 lit. f GDPR. The audit company has a legitimate interest to receive information on the persons receiving the report to ensure compliance with its terms and conditions.
You may submit job applications through our website. The personal data that you provide to us as part of your application will be processed exclusively for the purpose of the application process. This includes information about you (e.g. name, contact details, date of birth), information about your specialist skills (e.g. school education, trainings, other skills) and proof of corresponding information (e.g. certificates), which you provide with your application. Legal basis for the processing is Art. 6 para. 1 s. 1 lit. b GDPR in conjunction with corresponding national regulations (If applicable).
In case your application refers to a position at another of the VIVION group of companies, which includes – inter alia – VIVION Holdings Sarl, VIVION Investments Sarl, VIVION Capital Partners SAS, and their direct and indirect subsidiaries, we will forward your application to the respective entity. The transfer is justified by Art. 6 para. 1 s. 1 lit. b GDPR and Art. 6 para. 1 s. 1 lit. f GDPR as we have a legitimate interest to properly process job application within the group of companies.
The personal data processed in relation to applicants will be deleted six months after completion of the application process, unless this data is legitimately required for other purposes, particularly the performance of the employment contract if you start an employment with us. Other retention obligations remain unaffected.
If you contact us with inquiries or for other purposes, we will process your contact details as well as the content of your request in order to handle your request and in case of follow-up questions. This might also include forwarding your inquiry to one of the VIVION group of companies.
The legal basis for the processing is Art. 6 para. 1 s. 1 lit. b GDPR and Art. 6 para. 1 s. 1 lit. f GDPR as we have a legitimate interest to properly process inquiries. The personal data will be deleted after completion of the request, unless there is a legal basis for retaining the data. Retention obligations remain unaffected.
A transfer to other recipients will only take place if a legal permission or obligation exists or if you provide your explicit consent.
Personal data may be disclosed to contractors who assist us in providing our services. The legal basis is Article 28 GDPR in conjunction with data processing agreements, which ensure that the contractors process your personal data only in accordance with our instructions and to the extent permitted by law.
III. YOUR RIGHTS
Depending on the circumstances of the specific case, you may be entitled to the following data protection rights:
1. Request information whether your personal data is retained and access to or duplicates of your personal data retained, including the purposes of the processing, the categories of personal data concerned, and the data recipients as well as potential retention periods;
2. Request to have the data that you have provided to us submitted to you or to a third party in a standard, machine-readable format. If you require the direct transfer of data to another controller, this will be done to the extent technically feasible;
3. Request rectification, removal or restriction of your personal data, e.g. because (i) it is incomplete or inaccurate, (ii) it is no longer needed for the purposes for which it was collected, or (iii) the consent on which the processing was based has been withdrawn;
4. Where data processing is based on your consent refuse to provide and – without impact to data processing activities that have taken place before such withdrawal – withdraw your consent to processing of your personal data at any time;
5. Take legal actions in relation to any potential breach of your rights regarding the processing of your personal data, as well as to lodge complaints before the competent data protection regulators.
